I think you're getting details of two separate projects mixed together or something. The "made a video burning books of people who emailed about getting their copy" thing was Pictures for Sad Children, which was not a graphic novel (it was a print collection of an episodic webcomic), did not have a class-action lawsuit, and in the end the creator did not "pay up" any refunds, but rather Max Temkin, the Cards Against Humanity guy, stepped in and paid the remaining shipping costs so people could get their books.
