In this case you would soon kill off all the executioners, judges, and law enforcement in your society, in order to keep them from harming more people. Any attempt to stop the cycle of death would require immunizing a class of murderers from punishment. Then you have the worst of both worlds - no safety from murderers, nor justice for the innocent.
