Actually, it is. Trying everything doesn't mean you're not giving up. It just means you tried before giving up... Maybe go somewhere with better internet. One time, my internet was out. But I went to a McDonalds parking lot to suck the life out of their WiFi to download a game. Took a little extra time, but still. I also used my Laundromat's WiFi to download a game. That's just because I was there, though...

Try those. Then you can give up if they don't work for you...

I'm not that surprised. While I don't see refunds much, I do know Nintendo is pretty good and tried to help... At least, from my experience with them...
