Maybe go somewhere with better internet. One time, my internet was out. But I went to a McDonalds parking lot to suck the life out of their WiFi to download a game. Took a little extra time, but still. I also used my Laundromat's WiFi to download a game. That's just because I was there, though... Try those. Then you can give up if they don't work for you... CTLM posted... I'm lucky; no problems ever from the eshop. I'm surprised you got a refund as I'm not that surprised. While I don't see refunds much, I do know Nintendo is pretty good and tried to help...
