Except it really doesn't. When the death penalty was the universally accepted punishment for murder and horsethievery, it hardly discouraged anybody. The only reason the horsethievery rates went down is because we replaced horses.

Such laws do exist, just not in the US.

That's a little crazy, since there's the matter of public safety with certain kinds of crime (rape, theft, fraud, etc, which have high recidivism rates). And it's a lot harder to reform an adult than a child.
