That last part is critical. If there's no DNA evidence submitted, the death penalty should, by law, not be allowed to be considered. And instead of putting these sickos in prisons to wait 10+ years to die, just go shoot their brains out behind the courthouse. Who cares about ethics when what the bad guy did wasn't ethical?
