I'd say there's a lot less incidents of banks giving the wrong person $100k than them running promotional competitions.

Driving up operating costs. It's an option, certainly, but when they have the law to back them up, why would they spend extra money on insurance?

When they're covered for losses from their mistakes, why should the law be on their side?

Sure, that doesn't define the specific protocol for "[taking] reasonable measures to return the property," but most (including the salient courts in this case) would agree that it includes calling the bank to ask what happened and why they'd been given the money before spending it all.

Note the word knows.

They don't know anything. It wasn't cash left on a park bench, it was a deposit in to their personal account that passed several security checks.

If a person drops their wallet you can't take it, but if they put it in your pocket you can assume they want you to have it.
