The ridiculous behavior - in my view - is on the part of DOJ's request that SCOTUS just yolo it and rule on equal protection. That's the egregious act and worthy of discussion as another in a long list of this administration's actions IMO. Slate's article frames it as though SCOTUS is the villain but that isn't true - at least with respect to the scenario here - unless of course that nightmare scenario does take place.
