They are obligated to include every defamatory tweet in this retraction letter according to the Texas Defamation Mitigation Act in order to proceed with litigation if they don't comply. It's a procedural thing, and while it's silly for them to say it's false because he can't be fecal matter, it's obligatory that they need to try and debunk each part of a statement when there's a larger one included in the tweet (such as implying he's committed crimes).

You can claim the implications are just that, but there are 400 other Tweets that also provide total context for these statements, and if they want every trace of it removed, the silliness is included. These will obviously not be included in any real filings, and it is just a procedural thing they had to go through.

Currently in the case, the legal team for Ron Toye and Monica Rial was trying to play a dirty game to get Vic deposed first and then file a protective order before Ron and Monica got deposed so only Vic's deposition would be public before the Judge had to be involved, ludicrously at this stage, to stop it and force no protective orders until after the depositions. They have also had rather nonsensical filings since they were first served their Complaint that are subject to ridicule for citing unverifiable Tumblr blogs and editable forums.

Jamie Marchi, meanwhile, was dodging service and hiding in her home and refusing to answer the door when they continually tried to serve her. She has since claimed that a service processor was lying the whole time, including about leaving her service on deliveries she had, in order to make it seem like she wasn't hiding from it.

Funimation, meanwhile, has been given an extension until after the other parties can go through discovery, presumably so they can settle because the current plan seems to be for them to dumpster their whole case, claim they were all agents of Funimation, and then force Funimation to foot the entire bill of the damages. Funimation settling and giving Vic's counsel would force the other parties (Ron Toye, Monica Rial, and Jamie Marchi) to pay for the remainder of what dollar amount they don't settle for.

It's honestly a gigantic mess, but discovery is due for Toye and Rial next week, so that will be fun.
