If he had shot the guy you could at least argue that maybe he thought the thief was gonna kill him but this dude beat him until he was subdued and then kept beating him to the point that he died from the injuries. Thats not self defense We have laws and a thief should go to prison ideally You can also get in a fight and accidentally kill someone. It's a thing that happens from time to time.
