Maybe I misunderstood the article I was reading (Or the guy at Yahoo that wrote it didn't understand the rules), but I got the feeling from it that this just wasn't a case covered by the rules even though it 'should' be illegal. you're talking about sign stealing which is a questionable practice but not against the rules using unapproved electronic equipment or acceptable equipment in unapproved ways is blatantly against the rules and this is what they are going to be punished for, and probably strongly.
