He's giving you the narrative from the Judicial Branch's point of view: Freedom of Speech within the United States specifically is the inability for Congress to establish laws that abridge freedom of speech. This protection extends to public services. BYU, however, is a private school and is exempt from that protection and can establish rules such as the above (as it is no longer a public entity nor government abridging that freedom). There are several other private universities that apply similar restrictions (with varying degrees of harshness) --- We're surrounding you. We see you, but you probably don't see us.
