It's not illegal. It's protected right of speech. That doesn't however mean that there aren't consequences for doing it. Burning crosses/flags/even threatening your ex over facebook is all freedom of speech, but that doesn't mean you won't get investigated for being an idiot.
As far as I can tell the Secret Service (not the media or left/right) is treating this exactly the same as they treated Nugent.
