It's not a contradiction. Bathrooms are segregated by physical sex, not gender, and everyone claiming otherwise or crying discrimination is wrong. Period.

That being said, I don't personally have an issue with someone who is passable using the opposite-sex restroom. If you look like Buck Angel, for example, and no one can tell, it's not a problem to use the men's room. If you can't pass for the opposite gender, then you use the one that matches your physical sex and check your feelings at the door, like I said.

Actually some people could tell with Buck Angel. Those hips aren't made from Testosterone.
