Sure it does. Don't sell it, and then sue Square-Enix for misleading them into purchasing X amount of copies that they now cannot sell without promoting competition.
Refusing to sell preorders to people will cause significantly more problems than this current issue.
Doesn't work like that. You can't sue someone because they made a deal with your competition.
