The order was to kill Bucky. Which was why Captain America went out on his own.

As a backup Zemo had proof that he killed Tony's parents which lead to him finding out that Steve knew. There was never going to be some sort of middle ground there. The accords would inherently side with Tony. The same people would side with Steve. The events would still overall play out the same. You have already argued that both characters would disregard the accords if they wanted.

You seem to have a knack of just disregarding why everything happened the way it did and just act like it wouldn't matter if the scenario was slightly different.
