No, it's still intellectual property. But now you know why NFTs are so stupid. You can't take something back that's already in the wild.
I know that's true if they use the same code, but reverse engineering entirely new code has always been fair game (at least in the courts.) Unless of course, the defendant had gotten the code through illegal means such as claiming they were suing T2, and going to the patents office and getting a copy of their codes.
