Feel free to email the Justice Department with your suggestion that they take this to court and then refuse to pay out when they inevitably lose, then. I find it really fucking funny that you think the worst thing that could happen in this instance is that the US government loses some money, and not what would be brought to light during the proceedings... oh, and let's not forget the millions and millions of dollars for each of these 900+ cases going to court instead of being settled, lol. So much for avoiding expenses.

You can sue government agencies, which is what has been done here. Please stop pretending you understand US law; if it could not be done, the over 900 lawsuits here would have already been thrown out.
They would not be negotiating settlements if the case could not be made.

How many times does it have to be explained that they DID NOT break the law? People have the legal right to cross borders to seek asylum and the law is very clear on this subject.

The Convention further stipulates that, subject to specific exceptions, refugees should not be penalized for their illegal entry or stay. This recognizes that the seeking of asylum can require refugees to breach immigration rules.

The Trump administration's policy violated US law, international law, and probably multiple treaties as well. They will get FUCKED in court, and the court costs alone will vastly outweigh these settlements.
