He was so concerned about the safety of the child in his car that he drove like a reckless moron before the confrontation, then even more recklessly once it was safe, in order to flee the crime scene (or, even if you believe him, to call a lawyer, that's not a physical safety issue especially for the child), hitting cars along the way creating impacts that could've harmed the child.
He didn't exhibit any concern for the child, just himself.

Also if they overcharge (like they did with George Zimmerman and Casey Anthony) then he might be not guilty. If they go for a lesser charge like manslaughter then I be they could win it easier.
Those weren't "overcharges" and at most you could say maybe 2nd degree murder instead of 1st degree. The fact they're already going w/ 1st degree probably means they're confident they can back it up in court, though. No fucking way is this less than some degree of murder.
