Even if you argue the "without legal right" -- which is a stretch given that police are more readily able to search somebody's vehicle or person without warrant than they are to search somebody's home which has a lot more protections -- things taken as evidence get returned, excluding illegal or stolen objects. It was being illegally taken so there is no guarantee things will go by the book as they already aren't going by the book. You can't make a reasonable argument suggesting he will definitely get his stuff back from an illegal seizure. ... Copied to Clipboard! |
