Judge Sally Berens said Franks was a danger to the community and should be held in custody awaiting trial She said "I don't have a crystal ball. I don't have any ability to see the future. The best indicator of future behaviour is past behaviour. This is a very serious crime" Lawyers are arguing he should be released both on health grounds and that he's a "low flight risk" as he has diabetes and high cholesterol who needs insulin daily and fears he'll contract the deadly virus They also point out he has his own house and a good job at "Meridian Health Systems" that helps pay for his drug and alcohol addicts before his arrest and lives with his fiance and her mother both with clean records He said his client helped others with their drug addictions and represents the "ideal of a once drug offender turning his life around" But prosecutors said he was deeply involved in a self styled militia's plot and told them he was "in for anything".
