I'd have thought the default position was that the publisher owned everything. Shouldn't the burden of proof be on him?

(Not a lawyer, obviously. I just thought that it was extremely rare for comic writers to keep the rights to anything)
He filed a legal copyright for the characters and stories and then Archie filed a cease and desist. After doing so, he challenged that he owned the rights to the characters and they didn't present Penders contract claiming he gives up all ownership of the characters he created to them. It is standard in contracts, but because they couldn't present a contract and knew it would end up being a messy legal battle, they settled and said that this guy can have his shitty characters and comics.

So Ken Penders is now the proud owner of a dead bee that overdosed on LSD chili.
