Here is the thing, even knowing how to swim is a far cry from being trained in water rescue techniques. You send someone who doesn't know proper water rescue techniques in to save a drowning person and you end up with two drowning people. As a general rule you don't even send trained water rescue personnel in after a drowning person unless they have a flotation device as it is too easy for the struggling drowning person to kill even experienced swimmers.

So what you are really asking for is that all cops know how to swim, be trained in water rescue, and carry flotation devices on them at all times. That is not realistic in the least for a job that is 99% on land.

Also being able to swim be a minimum requirement unfairly discriminates against people who grew up in urban areas or from poor financial backgrounds as these individuals don't have the same access to pools or the time/resources to have swimming lessons.

This is a sad situation, but made the correct decision in not going after him.
