If you tried to make a Little Mermaid movie with a redheaded mermaid, you'd likely be sued for it. If nothing else was consistent with Disney beyond that, their lawyers would state that your mermaid was copying their copyrighted interpretation of said public domain character. Hell, they might even go as far as to sue someone for simply having a redheaded mermaid.


I think Warner Bros Jungle Book contradicts that a fair bit.

I'm sure there are some aspect of Little Mermaid that are copyrighted (Sebastian for example and I'm sure the animated design and Ariel's outfit are copyrighted) but I don't think they can dispute stuff as vague as redheaded mermaids.
