Batman might be an insane guy that fights people in a bat suit, but he's also an insane guy that fights people in a bat suit who's very intelligent, have some kind of common sense and is highly organized. Him killing Joker turning him into an outright villain and throwing all that he's established for himself as Batman would be dumb. At worst, he would probably stick to killing major villains and even then I doubt that.
