Given Uber's anti-discrimination policies, I doubt he'll be able to keep driving for them after this incident is investigated, unless he can convince them the girls were doing a lot more than a quick kiss. He would've faced penalties asking them to stop too. Not necessarily, but if he did, he'd have solid legal grounds for appealing those penalties, given Uber's anti-sex-in-the-back-seat policies. He'd lose that appeal if evidence surfaced that he was fine with straight couples making out, or was otherwise more lenient with straight couples than gay ones (since that's being discriminatory in how he applies Uber's policies), but he'd still have a shot.
