I literally didn't say anything about conviction.

Anyway if he was charged with murder 2nd degree but they couldn't pin that on him that's the prosecution's fault. It looks as though the prosecution had a fixation on arguing that the shot was intended to kill which meant they were likely trying to argue it was a non-premeditated murder (2nd degree) instead of casual disregard for human life (also murder 2nd degree, but the argument you use in court makes all the difference.)


He was charged on first, second and manslaughter. Again, disregard for human life is not 2nd degree murder. Murder is always in some way intentional. That's what makes it murder.
