Anyway if he was charged with murder 2nd degree but they couldn't pin that on him that's the prosecution's fault. It looks as though the prosecution had a fixation on arguing that the shot was intended to kill which meant they were likely trying to argue it was a non-premeditated murder (2nd degree) instead of casual disregard for human life (also murder 2nd degree, but the argument you use in court makes all the difference.) --- ...
