Juries are a state function. And the state decides whether to seek the death penalty in the first place. They decide what evidence to present and what to withhold. They decide what crimes are eligible for the death sentence in the first place. They decide whether they have the death penalty. They decide who is pardoned or has their sentence reduced to life in prison. They carry out the killing. It's a state decision and a state action.

Additionally, the Supreme Court has explicitly held that it is unconstitutional to execute even child rapists. It is only legal to execute people who intentionally killed other humans. This would be an illegal and morally repugnant law.
