Activision saying that the rating is "pending and being fixed" isn't exactly confirmation of anything other than that it got a tentative AO rating and they're tweaking the game to resolve the issues. Movies work the same way, where they get a tentative MPAA rating with a list of which scenes led to the rating and then the studio will haggle with the ratings board over cutting certain scenes to negotiate it back down to a PG-13 or whatever they want.

And as for the "real gambling isn't in out game" claim from Activision, that could just mean they're going to patch it in like they did with a bunch of other games in the past. "It isn't in our game", even if we give them the benefit of the doubt that they're using the exact same definition of "real gambling" as the ESRB, isn't the same as saying "it will never be in our game."

Activision makes AssCreed games now? I thought that was Ubisofts gimmick.
