In which case, any incident is on them for driving in an unsafe manner.


Maybe that's how it is in Canada, but here in the States, including mine, even if you're not directly at fault you're still partly to blame because you were on the road to begin with.


Are you really letting the law define your concept of responsible driving? Pay attention, and if somebody who isn't paying attention causes a problem, blame them. Don't blame people who did nothing that would have been dangerous if you'd just paid attention. That's just plain common sense.
