here's the thing though, for the people who still couldn't afford health care, they don't get penalized for it.

when you do your taxes, if you claim it wasn't affordable for the entire year, so you never had it, the penalty is waived.

Source for this exemption? And bearing in mind that affordable has many connotations and, even if it was affordable on paper, some people might still rather spend their money in other ways (such investing rather than putting into premiums)
