I think I remember reading that according to formal rules of etiquette, a former president is to be addressed as Mr. (or Miss / Mrs. if applicable), or the highest title other formerly held, like Governor or Senator. Since no other government titles apply in Trump's case, in a formal setting like court, "Mr." it is. Or "the defendant".

Correct, it's like even a law that when it comes to government activities only the current President is referred to as President. We only refer to Clinton/Obama as President Clinton/Obama out of formality, there is no actual legal or governmental basis requiring us to refer to them as such.
