You don't trust the person to make that call because by definition they're not thinking clearly. "Let the drunk guy decide how drunk he is" is one of the stupidest suggestions you could make. Don't drink and drive. It doesn't get any simpler than that. If you drink, you don't drive. If you do, you deserve to get arrested.
