It would be unfair to excuse her, because that was the rules of the challenge.

But they did excuse her. If she had decided to leave the challenge, that's one thing, but she didn't. The production crew told her she had to leave. They tried to have it both ways.

The men should have won in the sense that had the challenge played out the women would have been unable to get all of their members to the end since Courtney was not present, but that presents a paradox. Wouldn't not being able to participate in your team's immunity challenge disqualify you from the game? And if so, that means that Courtney would have been instantly disqualified the second that the challenge restarted, presumably leading the producers to end the challenge right then. If Courtney had actually returned it would have meant that she was able to remain in the game despite not participating in a mandatory Immunity Challenge, albeit one that the producers chose not to play out to completion. I mean the men would have most likely won, but it is theoretically possible for them to still lose the challenge if someone took hours to cross the balance beam, Courtney returning in the meantime.
