The situation where she doesn't technically ask for it but you do it anyway. Then if she gets moody a few weeks later she can now accuse you of rape.
There is basically no way of providing evidence that you fingered a girl you were intimate with when she didn't want it. If you do it and she reports it the same night or the next day, maybe the conviction will stick, and if she really didn't want it... good. If she accuses you of banging her a couple weeks later, it's probably not going to go anywhere.

This law is for cases where people get groped and molested by strangers or people they know (boyfriends, family members, teachers, etc) against their will. They're basically saying that having someone rape you with a finger or two isn't any less punishable than being raped with a penis, and that's how it should be.




Except that won't stop charges from being pressed, even if there is no conviction. Look at the Duke lacrosse case-- even mere accusations can ruin someone's life.
