After World War II and the horrors experienced by refugees who were turned away by the United States and elsewhere, Congress joined the international community in adopting standards for the treatment of those fleeing persecution, lawyers with the A.C.L.U. wrote. A key safeguard is the assurance, explicitly and unambiguously codified, that one fleeing persecution can seek asylum regardless of where, or how, he or she enters the country.

WASHINGTON The Supreme Court on Friday refused to revive a Trump administration initiative barring migrants who enter the country illegally from seeking asylum.

The court was closely divided, with Chief Justice John G. Roberts Jr. joining the four-member liberal wing in turning down the administrations request for a stay of a trial judges order blocking the program.

The courts brief order gave no reasons for its action. Justices Clarence Thomas, Samuel A. Alito Jr., Neil M. Gorsuch and Brett M. Kavanaugh said they would have granted the stay.

In a proclamation issued on Nov. 9, President Trump barred migrants from applying for asylum unless they made the request at a legal checkpoint. Only those applying at a port of entry would be eligible, Mr. Trump said, invoking what he said were his national security powers to protect the nations borders.

Lower courts blocked the initiative, ruling that a federal law plainly allowed asylum applications from people who had entered the country unlawfully.

Any alien who is physically present in the United States or who arrives in the United States, the relevant federal statute says, may apply for asylum whether or not at a designated port of arrival.

Judge Jon S. Tigar of the United States District Court in San Francisco issued a temporary restraining order blocking the initiative nationwide. Whatever the scope of the presidents authority, Judge Tigar wrote, he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden.

Mr. Trump attacked Judge Tigar, calling him an Obama judge. Chief Justice John G. Roberts Jr. took issue with the characterization, saying that federal judges apply the law without regard to the policies of the presidents who appointed them.

A divided three-judge panel of the United States Court of Appeals for the Ninth Circuit, in San Francisco, refused to stay Judge Tigars order. The majority opinion was written by Judge Jay S. Bybee, who was appointed by President George W. Bush.

CHARLOTTESVILLE, Va. (AP) A man who drove his car into a crowd of counterprotesters at a white nationalist rally in Virginia was convicted Friday of first-degree murder for killing a woman in an attack that inflamed long-simmering racial and political tensions across the country.

A state jury rejected arguments that James Alex Fields Jr. acted in self-defense during a Unite the Right rally in Charlottesville on Aug. 12, 2017. Jurors also convicted Fields of eight other charges, including aggravated malicious wounding and hit and run.

Fields, 21, drove to Virginia from his home in Maumee, Ohio, to support the white nationalists. As a large group of counterprotesters marched through Charlottesville singing and laughing, he stopped his car, backed up, then sped into the crowd, according to testimony from witnesses and video surveillance shown to jurors.

Prosecutors told the jury that Fields was angry after witnessing violent clashes between the two sides earlier in the day. The violence prompted police to shut down the rally before it even officially began.

Heather Heyer, a 32-year-old paralegal and civil rights activist, was killed, and nearly three dozen others were injured. The trial featured emotional testimony from survivors who described devastating injuries and long, complicated recoveries.

The far-right rally had been organized in part to protest the planned removal of a statue of Confederate Gen. Robert E. Lee. Hundreds of Ku Klux Klan members, neo-Nazis and other white nationalists emboldened by the election of President Donald Trump streamed into the college town for one of the largest gatherings of white supremacists in a decade. Some dressed in battle gear.

Afterward, Trump inflamed tensions even further when he said both sides were to blame, a comment some saw as a refusal to condemn racism.

According to one of his former teachers, Fields was known in high school for being fascinated with Nazism and idolizing Adolf Hitler. Jurors were shown a text message he sent to his mother days before the rally that included an image of the notorious German dictator. When his mother pleaded with him to be careful, he replied: were not the one (sic) who need to be careful.

During one of two recorded phone calls Fields made to his mother from jail in the months after he was arrested, he told her he had been mobbed by a violent group of terrorists at the rally. In another, Fields referred to the mother of the woman who was killed as a communist and one of those anti-white supremacists.

Prosecutors also showed jurors a meme Fields posted on Instagram three months before the rally in which bodies are shown being thrown into the air after a car hits a crowd of people identified as protesters. He posted the meme publicly to his Instagram page and sent a similar image as a private message to a friend in May 2017.

But Fields lawyers told the jury that he drove into the crowd on the day of the rally because he feared for his life and was scared to death by earlier violence he had witnessed. A video of Fields being interrogated after the crash showed him sobbing and hyperventilating after he was told a woman had died and others were seriously injured.

The jury will reconvene Monday to determine a sentence. Under the law, jurors can recommend from 20 years to life in prison.

Fields is eligible for the death penalty if convicted of separate federal hate crime charges. No trial has been scheduled yet.

Chief Justice John Roberts made a rare statement on Wednesday pushing back against President Donald Trump after the President again went after federal judges.
"We do not have Obama judges or Trump judges, Bush judges or Clinton judges," Roberts said. "What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. That independent judiciary is something we should all be thankful for."
Roberts' comment came in response to an inquiry from The Associated Press. On Tuesday, Trump slammed the 9th Circuit Court of Appeals again, this time after a judge from the Northern District of California -- where cases get appealed to the 9th Circuit -- issued a temporary restraining order blocking the Trump administration from barring migrants who cross into the US illegally from seeking asylum.
"It's a disgrace when every case gets filed in the 9th Circuit," Trump said as part of a lengthy criticism of the court. "That's not law. Every case in the 9th Circuit we get beaten and then we end up having to go to the Supreme Court like the travel ban and we won. Every case, no matter where it is, they file is practically, for all intents and purposes, they file it in what's called the 9th Circuit. This was an Obama judge. I'll tell you what, it's not going to happen like this anymore."

Roberts, who then-President George W. Bush tapped to lead the Supreme Court, is the highest authority in the federal judiciary, and his remark was a rare direct response to the head of the Executive Branch.
Speaking at the University of Minnesota Law School in October, Roberts emphasized the Supreme Court's independence and differences from the other branches.
"I will not criticize the political branches," Roberts said. "We do that often enough in our opinions. But what I would like to do, briefly, is emphasize how the judicial branch is -- how it must be -- very different."

Trump has been a frequent critic of the 9th Circuit, and just a few months into his presidency, Trump said he was considering breaking up the circuit that covers a slew of western states and Guam.
Several of his most controversial policies have been held up by judges there, and the temporary block on his attempt to rewrite asylum rules marked the latest such instance.
