I've never heard where the jury decides the punishment except in death penalty cases. The idea that a defendant would plead guilty and the *jury* would pick punishment is completely foreign to me.

I'd say Rodriguez has been forced into lawyers heads incessantly for the last couple years. Now *every* stop that finds drugs is challenged as an unlawful extension. I suppose people could represent themselves and not know to bring this up, but is less and less likely when it comes to cases that "matter."

In my State, virtually nobody has to post a bond/bail for a DWI/DUI due to some case law on the subject. Can't remember if it's nationwide or just our state.

Unless you meant at his trial, but I would think just about everybody gets no jail time for a first offense with nobody hurt, etc.

I've seen these cases before. There's nothing that will significantly happen. And his parents/attorney will talk about how his "obvious joke" is being blown away out of proportion because of the current climate. "He didn't mean it/didn't hurt anybody."

It's possibly because they're cowards, but we had a standoff in a neighboring county where a cop, in the course of his job (not off duty) had been taken hostage, and everyone still stood outside for forever. Nobody has any training on these things and nobody wants to give a "kill" order.

Really hard to tell where the majority of CE falls on this topic.
