like remember the dumbass rules for quidditch? where the snitch is worth 150pts and instantly ends the game. Which makes the regular/main scoring method to be near completely pointless. and yet she still has people catch the snitch despite them knowing it will make them lose.

If I recall, the scores were aggregated so that the winner between the houses was based on points rather than W/L record.

From the streams I've watched, it made me think that the sentiment would be akin to the Red Wedding without the Purple Wedding or any other antagonist getting their comeuppance after. Just kind of a "Really? All that time and the prices paid?"

It was draining to watch, and I honestly am not that invested in TLOU. Is it bad? Not necessarily. But I thought it an unsatisfying arc.

He attached an academic article to the complaint (which is not how you go about filing complaints or rocking expert witness materials period), which I imagine required some amount of time and effort to acquire and read through (and possibly money).

Like I've seen my fair share of suits I thought were frivolous but at least had a kernel of substance that made me trust my former bosses during my clerkship (and it wasn't my ass on the line, since all I had to do was find some amount of research materials and cobble together pleadings and briefs), but this is just absolutely hysterical to me.

Even for a pro se complaint, this is a special breed of frivolous and stupid.

Illegal in the sense that the California Code of Civil Procedure prohibits it and grants the defending party the right to seek attorney's fees for frivolous claims.

I don't imagine this guy has anything, and it honestly wouldn't be worth it. All Twitch has to do is get their lawyer to file a 12(b)(6) motion (or whatever the state code equivalent for California would be) to dismiss.

I don't remember it like that, I just remember he used it to A) keep track of the police investigation to see who they were suspecting of being Kira so they wouldn't be able to come after him and B) to get a list of criminals to kill

I don't remember anything about having really bad guys go free and petty criminals locked up. I mean there were some people who did crimes in the past that were released after doing their time or didn't get jail sentence that he used (I specifically remember him killing a guy at the subway to show Ray Pember who he was who had some kind of sexual crime in the past). But he didn't set his goals on that based on access to the police files, that's just something he just generally observed about the world that there were too many assholes (the bully at his school, the catcaller in the street, etc)

Yeah, both people incarcerated and those who slipped through the cracks (by his definition, at any rate) were fair game.

There was also the strategy of killing major criminals off w/ heart attacks to establish Kira's modus operandi, and killing off petty offenders (and possibly other undesirables that didn't cross the line into legal criminality, but were still not "good people" by Light's definition) through other, less obvious means to cover up the total extent of his efforts to change the world.

Pretty casually, but I'm usually fairly good about gauging my audience.

In unfamiliar or more formal circumstances, it's just a wait and see until whoever I'm talking to swears, and I scale accordingly. The judge I'll be clerking for in August dropped a casual "fuck" during my interview, and so I loosened up my tongue a little bit because my filter disappears once I get that audio trigger.

Solid 8/10. Had a lot of fun with it. The only better parkour system I've experienced would be from Mirror's Edge, but the grappling hook is tons of fun to play with.

My gripes are that Nightmare has gawd-awful spongy enemies, and the guns just feel blah. I would have preferred they have more oomph in exchange for boolets being more rare. More enemy variety would have been nice, as well as more incentive/more missions requiring you to go out at night. Outside of the couple mandatory parts, there's really not much incentive to actually go out at night beyond the XP, which loses its luster when you get to a certain point.

There are wrinkles to this, as I found while perusing Georgia case law. "Per se deadly weapons" are those whose innate use carries with it risk of death/severe bodily harm, etc. A taser would qualify under this when used as intended. However, here's a case snippet that adds the wrinkle:

Adsitt v. State, 248 Ga. 237, 240, 282 S.E.2d 305, 308 (1981)
We hold that if it reasonably appears to the assault victim that the firearm is or might be loaded then the assailant should be held to the consequences of using a deadly weaponwhether or not the weapon in fact is loaded.

This would give the impression (although within the aggravated assault context rather than estimation of force needed by a LEO, but it's easy enough to transition since the standard wouldn't change any) depends, as I've stated previously, on what the officers knew. DA (notwithstanding accusations of political motivation and other issues) stated that the officer gave a statement indicating he knew the taser had been expended.

If that statement is true, it's easy enough to distinguish between the previous use (if I recall, that was with the driver or passenger in a vehicle was hit with the taser? My memory isn't good at this point in time.) and the current use if the officer knew the taser could not be used as designed. Use as a bludgeon requires similar analysis in that it would be based on reasonable beliefs re: what Brooks could do with it.

As to whether this would impact whether the action would survive muster under Garner and Graham, I do not know. I'm not inclined to treat it as though a dismissal or directed verdict would be guaranteed. If the shooting occurred strictly in a vacuum, I'd give the defense 35%~ on dismissal and a 65%~ chance of successful directed verdict (numbers pulled out of my ass and mean nothing other than sleep-deprived me's gut instinct, and I'm known to undershoot strength of arguments).

The post-shooting actions I'm even more unsure
