Carlos Gregorio Hernandez Vasquez, a 16-year-old Guatemalan migrant, was seriously ill when immigration agents put him in a small South Texas holding cell with another sick boy on the afternoon of May 19.

A few hours earlier, a nurse practitioner at the Border Patrols dangerously overcrowded processing center in McAllen had diagnosed him with the flu and measured his fever at 103 degrees. She said that he should be checked again in two hours and taken to the emergency room if his condition worsened.

None of that happened. Worried that Carlos might infect other migrants in the teeming McAllen facility, officials moved him to a cell for quarantine at a Border Patrol station in nearby Weslaco.
By the next morning, he was dead.

In a press release that day, Customs and Border Protections acting commissioner at the time, John Sanders, called Carlos death a tragic loss. The agency said that an agent had found Carlos unresponsive after checking in on him. Sanders said the Border Patrol was committed to the health, safety and humane treatment of those in our custody.

But the record shows that the Border Patrol fell far short of that standard with Carlos. ProPublica has obtained video that documents the 16-year-olds last hours, and it shows that Border Patrol agents and health care workers at the Weslaco holding facility missed increasingly obvious signs that his condition was perilous.

The cellblock video shows Carlos writhing for at least 25 minutes on the floor and a concrete bench. It shows him staggering to the toilet and collapsing on the floor, where he remained in the same position for the next four and a half hours.

According to a subject activity log maintained by the Border Patrol throughout Carlos custody, an agent checked on him three times during the early morning hours in which he slipped from unconsciousness to death, but reported nothing alarming about the boy.

The video shows the only way CBP officials could have missed Carlos crisis is that they werent looking. His agony was apparent, even in grainy black and white, making clear the agent charged with monitoring him failed to perform adequate checks, if he even checked at all. The coroner who performed an autopsy on Carlos said she was told the agent occasionally looked into the cell through the window.

The video makes clear that CBP, the Border Patrols parent agency, inaccurately described how Carlos body was discovered. Contrary to the agencys press release, it was Carlos cellmate who found him, not agents doing an early morning check. On the video, the cellmate can be seen waking up and groggily walking to the toilet, where Carlos was lying in a pool of blood on the floor. He gestures for help at the cell door. Only then do agents enter the cell and discover that Carlos had died during the night.

Officials with the Department of Homeland Security, which includes CBP, wouldnt say whether the scenes recorded by the camera during Carlos final hours were shown live on video monitors, as is the case in some Border Patrol facilities, and if they were, whether anyone had been assigned to watch the footage.

The video and other records reviewed by ProPublica document numerous missteps in the days leading up to Carlos final hours on the floor of Cell 199. Independent medical experts pointed in particular to the decision to send a 16-year-old suffering from the flu to a holding cell rather than a hospital as a pivotal mistake.

Why is a teenaged boy in a jail facility at all if he is sick with a transmissible illness? Why isnt he at a hospital or at a home or clinic where he can get a warm bed, fluids, supervised attention and medical care? He is not a criminal, said Dr. Judy Melinek, a San Francisco-based forensic pathologist who reviewed records of Carlos death at the request of ProPublica. No one should die this way: vomiting, with a fever and without the comfort of a caregiver.

A CBP spokesman declined to respond to a series of questions about Carlos death, citing an ongoing internal investigation. While we cannot discuss specific information or details of this investigation, we can tell you that the Department of Homeland Security and this agency are looking into all aspects of this case to ensure all procedures were followed, CBP spokesperson Matt Leas said.

CBP has refused to release the video and other records of Carlos death to the public or Congress, citing the ongoing internal investigation. But using Texas open records laws, ProPublica obtained material from the Weslaco Police Department, which briefly investigated his death. The records included surveillance video, detainee logs and health records turned over to police by Border Patrol.

Interviews and documents illustrate how immigration and child welfare agencies, while grappling with surging migrant numbers, were unable to meet their own guidelines for processing and caring for children. With holding tanks that were never equipped to house migrants for more than a few hours, the Border Patrol was inundated with families and children. Shelters for children, offering beds and medical care, were already packed.

Several West Virginia government employees have been suspended after a photo emerged depicting a training class of roughly 30 correctional officers performing a Nazi salute.

Department of Military Affairs and Public Safety Director Jeff Sandy sent a letter to all employees Wednesday describing the photo as distasteful, hurtful, disturbing, highly insensitive, and completely inappropriate.

The photo, on state letterhead, shows almost all of Basic Training Class No. 18 displaying the Nazi salute. Text above the photo reads: HAIL BYRD!

Sandys letter states that the employees have been suspended and are under investigation, although it does not describe the photo itself.

Brian Abraham, an attorney for Gov. Jim Justice, said Thursday the Hail Byrd line refers to the training classs director.

The Nazi salute was used to hail Adolf Hitler, the Nazi Germany dictator who directed the slaughter of millions of Jews and others during the Holocaust, before and during World War II.

WCHS-TV first reported on Sandys letter, although not the content of the photo.

Rabbi Victor Urecki, of Bnai Jacob Synagogue in Charleston and regular figure around the Capitol, saw the photo. He thanked state officials for briefing him and other religious leaders in advance, but expressed concern over what comes next.

Seeing the photo was deeply shocking and troubling to me and I know it will be devastating to not just members of my community but any person of decency," he said.

"This will be create difficult days and hard conversations for our state. While I want to hear more about how it all unfolded, this terrible incident reminds me we have a lot of work to do in educating about the dangers of hate and the evils perpetrated in the past and can happen again.

The 49ers have suspended Tim Ryan, their radio color-analyst, over comments he made on a Bay Area sports talk radio show Monday in which he said Baltimore Ravens quarterback Lamar Jackson, who is black, is exceptional at faking handoffs because of his dark skin color with a dark football.

The comments came in the first couple minutes of Ryans weekly segment with KNBRs Murph and Mac morning radio show as the hosts asked the San Jose native about Jacksons performance in Sundays 20-17 victory over the 49ers. Jackson, a frontrunner to be named NFL MVP, rushed and passed for more than 100 yards in a game between two of the leagues top teams.

During a series of interviews on talk radio shows Wednesday morning, outgoing Republican Gov. Matt Bevin said that he lost his race for reelection because the Democratic Party harvested votes in urban communities.

Bevin lost to Democratic Attorney General Andy Beshear last month by a little more than 5,000 votes.

During an interview on 55KRC in Cincinnati, Bevin said that the election was a surprise that defies logic.

The left, those who think of a different ideological bent, they are getting so good at harvesting votes in the urban communities, Bevin said.

They were able to go into urban communities where people are densely populated on college campuses and public housing projects.

Bevin has repeatedly questioned the outcome of the election, suggesting without evidence that voter fraud took place.

Beshear did well in Kentuckys urban and suburban areas like Louisville, Lexington, Bowling Green, Richmond and northern Kentucky, as well as some historic Democratic strongholds in eastern Kentucky.

Vote harvesting refers to collecting absentee or mail-in ballots in order to sway an election. The practice is illegal in some states, but Kentucky is one of 27 states that allows absentee ballots to be returned by a designated agents.

Vote harvesting took place in the 2018 race for North Carolinas 9th Congressional district, which Bevin referenced in the aftermath of his failed reelection attempt. Vote harvesting is illegal in North Carolina and a new election was ordered in the race. [Antifar's note: the Republicans were the ones doing the harvesting in that case]
During the interview on 55KRC, Bevin said that he was encouraged by his supporters on Election Day, but that Democrats brought more less-informed people to the polls.
Conservatives are going to have to find some counterpoint, Bevin said. The harvesting of votes in urban cores in particular that is done by the left overwhelmed even that. And thats the difference, thats the tipping point.
In the wake of Election Day, Bevin alleged again without evidence that thousands of absentee ballots were improperly counted and that eligible voters were turned away from polls.
Bevin challenged the results, but conceded the election after a recanvass of the vote total produced a change of only one vote.
He also said that he thought there were irregularities with the election during his concession speech, saying that there is not any real sense of transparency for how the voting process works.

Shawnee Countys district attorney has asked the countys sheriffs office to investigate whether a Kansas congressman voted illegally in Topekas city election last month.

The Topeka Capital-Journal reported Tuesday that Rep. Steve Watkins, R-Kansas, changed his voter registration in August to the address of a UPS store in Topeka. The address, located in Topekas 8th City Council District, was the one he used in Novembers election when the winner of the council race was decided by just 13 votes.

The revelation immediately sparked calls for an investigation into whether the congressman had committed voter fraud, which Kansas has aggressively prosecuted in recent years.

Shawnee County District Attorney Mike Kagay confirmed Wednesday morning that he was aware of the matter and planned to conduct a preliminary review into whether Watkins broke the law.

I think its safe to say any time Im made aware of potential criminal wrongdoing arising from my jurisdiction its my responsibility to at least do my due diligence, Kagay told The Star.

A half hour later, Kagays office said that he had officially asked the Shawnee County Sheriffs Office to investigate the allegations.

As with any alleged criminal conduct said to have occurred within Shawnee County, I have requested that local law enforcement investigate the matter. In this instance, I have contacted the Shawnee County Sheriffs Office, Kagay said in a statement. Once their investigation is complete, law enforcement will forward the results to my office for review.

Watkins chief of staff Jim Joice has dismissed the controversy, saying that the freshman Republican made an error when he filled out his registration form in August.

Steve listed his mailing address instead of his physical address. He lives at the Overlook Apartments off Wanamaker (Rd.) in Topeka. This was inadvertent and both addresses are in the same county and same congressional district, so there was no improper purpose, Joice said. The paperwork is being corrected.

All of the addresses are in the same congressional district, but they fall into separate city council districts.

Watkins had previously been registered at an address in the 5th City Council District. The Overlook Apartments are in Topekas 9th City Council District.

Watkins voted in the 8th District race, where challenger Spencer Duncan defeated incumbent Jeff Coen by 13 votes.

Duncan, a statehouse lobbyist, said Wednesday he has known Watkins since childhood but that they are not close. Watkins was not involved in Duncans campaign, he said, and the two havent spoken since 2018.

It doesnt impact, at the end of the day, the outcome of the election, Duncan said. But Im like every citizen and voter. If theres voter fraud out there, it needs to be addressed.

How is DC terrible? It's a traditional football uniform with a lightning bolt theme.

Traditional is the last thing I want from the XFL. You need tradition to make traditional work.
