The rules of the game are independent of how the players feel like playing that day though. You can make up some very weird rules for whatever you play today, but if you go to a match there are set rules both sides agree to. You don't need Big Brother calling the shots. And how exactly would it cut into their bottom line if people started making spinoff mods that required the original game engine in order to play if people wanted to match up like that?

It's not about the bottom line. It's about differentiating a professional league from your company having a private golf tournament.

burgers probably not a good idea. bacteria gets all over the meat when it's ground including the insides.

for steaks it's different the meat is solid and bacteria is mostly outside only so you only have to actually cook the outside.

That's how sushi works, essentially, the outmost parts of the fish are cut off so you're just cutting out the bacteria. You can also make beef sushi that way but it's less common.

But I would never do that with ground beef.

They are. The most fundamental difference is that anything that isn't in the realm of esports has a set of rules that are more or less standard across a season if not universal. There aren't huge changes in the rules or in the physical layout of the game. In esports the company controls all of that and anything fair to change. They control the media outlets as well. They make sure there is so much DRM and EULA BS that creativity essentially has to have their stamp of approval, but their enforcement of the rules only matters where their own money is concerned.

I meant as far as economics are concerned. the flow of cash isn't really different.

Sure rules changes happen mid-season as balance and content patches are applied and such, but none of that affects the economy.

The NFL has a ton of legal documentation to go with its broadcasts. You generally don't end up messing with it much because a TV broadcast isn't interactive and isn't installed on your local computer. But I guarantee you real sports have legal documentation that absolutely crushes even the worst DRM / EULA video game shit you've ever seen. It's just the sponsors and networks that have to agree to it instead of the viewers.

It's because they make some game like Starcraft or whatever, which starts off as one thing but eventually ends up entirely different though microtransactions, patches, get people as hooked as possible and have them play that game as a career and sell it to other gamers by having them do streams and such. They know the microtransactions are shitty, they know they are trying to get people addicted, they know they are trying to build a culture of obsession on a particular game which just amounts to playing it and buying more microtransactions. Seems similar to a ponzi scheme to me anyway, if not the same thing. True they are more honest than an actual ponzi scheme.

Except money for all those games is flowing to Activision Blizzard. They're not flowing to investors outside of stock dividends. They also deliver an actual tangible product directly to consumer markets.

The eSports parts are not fundamentally run differently than sports leagues for other games. Even non sport games, like Bingo. The primary difference is your sponsor in Bingo is yourself, for about $5, and your sponsor in profenssional sports is a corporation that has you under contract and with a sponsorship for millions of dollars.

It's what the business model most closely resembles to me, regardless of whether it is technically a ponzi scheme in every way. You don't see every gaming company doing this, mostly the scummy ones.

The ponzi business model is that you take money from new investors to pay off older investors while your very first investors just pay you and the whole time you're lying about where the money is coming from.

Blizzard/Riot/Valve/etc sells you a game, makes you play a ranked mode, and if you're good enough in the ranked mode you receive a corporate sponsorship to compete in tournaments. They are also 100% honest about this.

How are these two models anything alike?

The license in this case is attached to the disc and non transferable (from the disc). Therefore, under the first sale doctrine you can resell that license.

What Zenimax is really suing for here is that he shouldn't be allowed to use their trademarks to sell games second hand.

I don't see how that will work. IIRC it's considered fair use to use a trademark to identify the company it belongs to.
