Irrelevant, because they did shoot her. We don't let drunk drivers off the hook because they didn't intend to rear end someone and kill them instantly.

Also the cops were in plainclothes and broke in the middle of the night, the boyfriend thought they were intruders. Probably because they weren't dressed like police officers for some reason.
