Number three is critical, and proof thereof can stem from many facts. Commingling of finances, cohabitation, being named together on a lease/deed/mortgage, acting as though married (ie "my husband/wife/spouse" to others. That's just a small spattering of facts relevant to the question of whether a couple is in a common law marriage.

In short, it's a way to be married without the official registration/costs associated therewith, and it entails all the benefits of marriage, as well as the downsides of divorce.
