https://nypost.com/2023/01/15/tiktok-trend-shows-users-sharing-their-hypothetical-death-row-meals/

If you were on death row, what would your last meal look like? TikToks latest bizarre trend has users asking themselves that question and uploading videos that disclose what they would choose to eat if they found themselves in the less-than-ideal situation. Diet Coke chicken pad Thai, saltines, [and] D chocolate chip cookie dough, made up user @chai.lattes.4ever oddly specific list. For another user called @babeinthewoodz, sushi, garden salsa Sun Chips, a blue raspberry lemonade from Sonic and a bowl of Orbeez chalked up another odd request. A third user named @drakeerussell said Chick-Fil-As chicken nuggets, Arnold Palmer half iced tea/half lemonade, caesar salad with chicken, Dots pretzels, Nerds and more comprised the list. Dr. Pepper, Philly cheesesteak, Ben & Jerrys ice cream, Chick-Fil-A, Takis, sushi and other popular foods earned spots on several peoples lists.

Despite its popularity on the controversial video-sharing platform, not everyone is on board with the #deathrowmeal trend. Tricia Crimmins, a staff writer with the Daily Dot, criticized the trend as being in poor taste. TikTokers are documenting what theyd want to be their last meals as wellbut, of course, they arent on death row. Thus many have found the trend to be insensitive and tone-deaf, she wrote. Crimmins criticized some users for saying goodbye at the end of their videos and making a more obvious allusion to death, but the majority of criticism in the post stemmed from users alleged lack of racial consciousness. TikToker @ngozimusa is quoted in the piece as criticizing the trend for racial insensitivity, saying she will abstain from participating because there is a direct correlation between race and capital punishment in the United States. People of color have accounted for a disproportionate 43 percent of executions since 1976, and the large majority of people doing this trend are not people of color, she added. She also bashed the allegedly insensitive trend further, saying that people of color are seven times more likely to be wrongfully convicted of murder in the United States.

https://patch.com/new-york/portwashington/friends-say-santos-wore-stolen-scarf-stolen-election-speech

Former friends of the embattled Long Island congressman George Santos said they believe he wore a stolen Burberry scarf as he delivered a speech Jan. 5, 2021 at a Freedom Plaza rally declaring that the 2020 congressional election was stolen from him. Santos spoke at the Stop the Steal "coalition pre-rally" the day before supporters of Former President Trump gathered at the U.S. Capitol on Jan. 6. According to a Newsday report, Santos said he attended the Jan. 6 rally but did not enter the Capitol. Two former Santos roommates, Gregory Morey-Parker and Yasser Rabello, told Patch they suspect Santos, 34, stole a Burberry scarf from Morey-Parker when Morey-Parker rented space from Santos in a Queens apartment he shared with his family. The two men previously told Patch several items went missing while they lived with Santos, including phones, expensive dress shirts and checks from a checkbook. The Republican lawmaker is accused of fabricating most of his biography and is under investigation for possible illegal campaign financing and disclosing. The Nassau County GOP called for his resignation Wednesday, calling him a "stain" on Congress and his district. Morey-Parker said he was "100 percent" certain the scarf was his when he saw video footage of Santos at the 2021 rally in Washington, D.C. A friend gifted it to him as he visited Santos, he remembered, and his missing scarf's color was "lighter than regular camel check."

Rabello told Patch that Morey-Parker messaged him to say Santos [who went by Anthony Devolder at the time] donned his swiped scarf during his first campaign for Congress in 2020. The two discussed "the shirt and scarf [Santos] stole" in a 2020 conversation. At the 2021 Freedom Plaza rally, Santos said, "If you're from New York, you know what they did to me. They did to me what they did to Donald Trump. They stole my election." He continued, "For 14 days I was congressman-elect of the 3rd Congressional District of New York the first ever biggest upset for a Republican in New York City." Santos lost the 2020 race for the 3rd Congressional District seat to incumbent Tom Suozzi. Before absentee votes were counted, which ended with Suozzi having a 10,000-vote lead, Santos went to freshmen orientation in Washington, D.C., where the election was then called for Suozzi, a representative from Suozzi's campaign team told Patch. In the speech, Santos said that "they sneaked in a few [votes] from my opponent" when counting his votes. According to Ballotpedia, Suozzi beat Santos 208,412 votes to 161, 907 votes, or 55.9 percent to 43.5 percent.

https://www.theguardian.com/us-news/2023/jan/09/house-republicans-defang-ethics-office-investigating-members

House Republicans moved to pre-emptively kill any investigations against its members as it curtailed the power of an independent ethics office just as it was weighing whether to open inquiries into lawmakers who defied subpoenas issued by the House January 6 select committee last year. The incoming Republican majority also paved the way for a new special subcommittee with a wide mandate to investigate the US justice department and intelligence agencies, which could include reviewing the criminal investigations into Donald Trump and a Republican congressman caught up in the Capitol attack inquiry. The measures took effect as House Republicans narrowly passed the new rules package that included the changes for the next Congress, 220-213, setting the stage for politically charged fights with the Biden administration over access to classified materials and details of criminal investigations. Seeking to protect itself, the rules package first undercut the ability of the office of congressional ethics (OCE) to function, with changes that struck at its principal vulnerabilities to defang its investigative powers for at least the next two years, according to sources familiar with its operation. The changes to the OCE are twofold: reintroducing term limits for members of the bipartisan board, which would force out three of four Democratic-appointed members, and restricting its ability to hire professional staff to the first 30 days of the new congressional session. In essence, the changes mean that by the time the OCE has a board, it may have run out of time to hire staff, leaving it with one counsel to do possible investigations into the new House speaker, Kevin McCarthy, and other Republican lawmakers who defied January 6 select committee subpoenas.

There would also only be that one counsel to investigate the Republican congressman George Santos, who lied about his past during his election campaign; the OCE has the power to retrospectively examine violations of federal election law that arise during congressional election campaigns. Meanwhile, as House Republicans moved to shield themselves from potential ethics investigations, they expanded their own investigative ability through the adoption of the rules package that allows for the creation of the special subcommittee to investigate the justice department and intelligence agencies. The text of the resolution creating the subcommittee scheduled for a vote on Tuesday on the weaponization of the federal government authorizes it to investigate any part of the federal government, including ongoing criminal investigations, which Republicans have indicated could extend to investigations into Trump.

https://www.nbcnews.com/news/asian-america/indiana-university-says-student-was-targeted-bus-stabbing-asian-rcna65770

Indiana University says an 18-year-old student was targeted and stabbed on a bus in Bloomington for being Asian. The student was attacked Wednesday afternoon on a Bloomington transit bus. Billie Davis, 56, has been charged with attempted murder, aggravated battery and battery by means of a deadly weapon, according to online court documents. An 18-year-old Carmel, Indiana, woman told investigators that while waiting for the doors of the bus to open, another passenger began to strike her repeatedly in the head, police said in a statement. The student, who has not been publicly identified, had multiple stab wounds to her head, was bleeding and was transported to a hospital, police said. Police said that based on video, the woman and suspect had no interaction before the attack. "This week, Bloomington was sadly reminded that anti-Asian hate is real and can have painful impacts on individuals and our community," said James Wimbush, Indiana University vice president of diversity, equity and multicultural affairs. "No one should face harassment or violence due to their background, ethnicity or heritage. Instead, the Bloomington and IU communities are stronger because of the vast diversity of identities and perspectives that make up our campus and community culture."

The university's Asian Culture Center called the attack "a horrific and targeted anti-Asian hate crime." "Our thoughts go out to the victim of this horrendous act, to her family, and to everyone in the community who is affected by this racial violence," it said in a statement Friday. "We are outraged and heartbroken by this unprovoked act of violence, but we also worry for the well-being of our community." The universitys Asian Culture Center hosted an event Friday for students and members of the community to process feelings of fear, sadness, anger, and anxiety, according to the centers Facebook. Police responded to a question about whether the attack is being investigated as a hate crime by pointing to the states relevant statute, which doesnt provide for specific hate crime charges. Because the legislature intentionally deleted gender identity and sex as possible motivating factors, the Anti-Defamation League said Indiana will remain on its list of states without a hate crime law.

Comedian Andy Dick was arrested in Lake Elsinore today on suspicion of public intoxication and failing to comply with sex offender registration requirements connected to a prior conviction. Dick, 57, of Hemet, was taken into custody about 12:30 a.m. at O'Hara's Rock & Roll Tavern in the 15700 block of Grand Avenue, according to the Riverside County Sheriff's Department. Dick was booked into the Byrd Detention Center in Murrieta, where he posted a $5,000 bond and was released a few hours later, according to jail records. Sheriff's Sgt. Pat Larson said patrol deputies were called to the bar after complaints of a patron "displaying signs of being under the influence of alcohol." Dick was detained without incident, after which deputies ran a records check, which indicated the suspect was "not up to date on his registration" under Penal Code section 290.

State law requires that registrants keep authorities informed as to where they're residing at all times. Dick was convicted in Los Angeles County last year of sexual battery for groping an Uber driver. The offense stemmed from a complaint four years earlier.

https://www.nbcnews.com/politics/congress/rep-george-santos-says-resign-142-people-ask-rcna65522

Rep. George Santos, the newly sworn-in New York Republican under fire for fabricating large parts of his rsum, told NBC News on Thursday that "if 142 people ask for me to resign, I will resign." He later clarified in an interview on "Steve Bannons War Room" with Rep. Matt Gaetz, R-Fla., that he was referring to the more than 142,000 people who elected him in November's race in New York's 3rd Congressional District. Santos said he would be in Congress "until those same 142,000 people tell me they don't want me." Santos has said repeatedly this week that he will not step down, despite calls for him to do so from leading Republican officials in his home state and a handful of his GOP colleagues in the House. A growing number of Republican lawmakers have called for Santos to resign in recent days, including at least four in New York and another out of state. Top officials from Santos' local Republican Party, the Nassau County GOP, said at a news conference Wednesday that he needs to step aside.

But House Speaker Kevin McCarthy, R-Calif., has so far said he won't join in the chorus trying to get Santos out. "I try to stick by the Constitution. The voters elected him to serve," McCarthy said this week. "If there is a concern, he has to go through the Ethics [Committee]; let him move through that. But right now, the voters have a voice in the decision. It's not where people pick and choose based upon what somebody's press has. So he will continue to serve." He has said Santos will get at least one committee assignment, although it will not be on a top committee.

https://www.dailymail.co.uk/news/article-11531705/Moment-trans-woman-hockey-player-concusses-trans-male-rival.html

A female-to-male transgender hockey player was left concussed after being knocked to the floor by a much larger male-to-female trans opponent during a controversial NHL-backed tournament. Danny Maki was knocked down and left concussed following what appeared to be an accidental rough hit at the Team Trans Ice Hockey draft in Middleton, Wisconsin, late last month. The incident has only just been reported by Quillette magazine, whose journalist Jonathan Kay suggested that the two-day tournament had been subjected to a woke cover-up. Maki was subsequently accused of self-censoring what had happened on Instagram by describing the incident as an 'odd fall,' despite himself sharing the video - which clearly shows he was tackled.

Some have said the incident was a prime example of the dangers of letting stronger and more powerful transgender women compete against small biological females, or transgender men. The incident could also deal a blow to progressives' obsession with 'equity', which dismisses equality of opportunity in favor of equality of outcome. Kay noted that the tournament outcome - which saw a team of trans women dominate - exemplified the problems with that dynamic in other competitions. Maki was playing for Team Black against Team Pink for the tournament, when he was struck on the ice by a pink-and-blue-haired team pink player who has so-far only been identified by her jersey number - 90. Quilette journalist Jonathan Kay watched the tournament in person, and accused the NHL, Vice, and Hockey News magazine of covering up the accident, as well as what he claims was an obvious advantage enjoyed by the trans-woman dominated Team Pink. The NHL posted a tweet hailing the groundbreaking tournament as a model of inclusivity - but made no mention of the outcome of the tournament. Vice News sent a five-person camera crew to record the games, but hasn't published or broadcast anything about the game. Hockey News parroted a line from Team Trans Ice Hockey's official Twitter account saying that 'the arena was buzzing with trans joy for two solid days.' No mention of results or the concussion was reported. Kay pointed out that Team Pink - which was largely comprised of trans women- not only won the entire tournament, but flattened the opposing Team Black - which had only two trans women - in the finals with a 7-1 win. 'There [was] just an enormous difference in size between the two teams height, weight, shoulder width, muscles the differences were plain to even a child,' Kay quoted a member of the audience telling him. 'I don't know how the teams were made,' they added. 'But any [fan] could see that this couldn't possibly be fair, and that someone could get hurt and someone did.'

https://www.cnbc.com/2022/12/13/biden-celebrates-easing-inflation-urges-americans-to-stick-with-his-policies.html

President Joe Biden on Tuesday celebrated the positive consumer price index report that showed inflation easing in the United States ahead of the holiday season. We learned last month that the inflation rate came down, down more than experts expected, Biden said, speaking from the White House. In a world where inflation is rising in double digits in many major economies around the world, inflation is coming down in America. The core consumer price index, which excludes food and energy costs and which economists view as a primary indicator of inflation, rose only 0.2% in November. Its the smallest monthly increase in over a year. The report released by the Labor Department on Tuesday found core CPI costs up 6% from a year ago. Overall CPI, which includes food and energy, rose 0.1% from the previous month and 7.1% over the last year. The easing suggests the Federal Reserves interest-rate increases could be working as intended and the Fed may be able to achieve the soft landing it wants, avoiding a large-scale economic recession. The report is likely to be reassuring to the Fed and the central banks Chair Jerome Powell. When it concludes its meeting on Wednesday, the Fed is expected to only increase interest rates by a half-point as opposed to the three-quarter point hikes it has deployed throughout the year.

The report marks the fifth month in a row where the rate of inflation has declined in the United States, Biden said. I want to be clear its going to take time to get inflation back to normal levels as we make the transition to a more stable and steady growth, Biden said. Biden, standing beside Council of Economic Advisers Chair Cecilia Rouse and National Economic Council Director Brian Deese, said he hopes prices will return to normal by the end of next year, if not sooner. But he stressed he cannot make that prediction. Im just convinced theyre not going to go up. Im convinced theyre going to continue to go down, he said. The president acknowledged that many Americans are currently struggling. But he said the positive economic news confirms that his economic policies are working, and urged Americans to stay the course. What is clear is my economic plan is working and were just getting started, Biden said. My goal is simple: get prices under control without choking off economic growth; bring inflation down while keeping the labor market resilient; build an economy from the bottom up and the middle out; an economy with good jobs, good wages and for the long run, not a boom or bust economy.

https://www.nbcnews.com/news/us-news/new-fbi-hate-crimes-report-undercounts-bigotry-based-attacks-racial-mi-rcna61217

The FBI on Monday released a hate crimes report for 2021 that it admits is incomplete and which, critics say, vastly undercounts bigotry-based attacks on Blacks, Jews, Asians and members of the LGBTQ community. Even so, the 7,262 hate crime incidents tallied in the report is the third-highest number reported in a decade and just a thousand shy of the 8,263 incidents recorded in 2020, according to bureau statistics. Associate Attorney General Vanita Gupta said the reason for the apparent undercount is that the FBI has implemented a new procedure for police departments to report crimes of all kinds to it called the national incident-based reporting system, or NIBRS and many of those departments have not yet started working with the program. According to the FBI, just 65% of police departments nationwide provided it with hate crimes statistics for 2021, compared to the 93% that did so the previous year. Even worse, critics say, the FBI's 2021 hate crimes report is missing key data from big states such as California and Florida where many of these incidents tend to be reported, and from some of the nations largest police jurisdictions, including New York City and Los Angeles. The significant decline in participating police agencies in 2021 due to a transition to a new platform killed the accuracy of national totals," said Brian Levin, director of the Center for the Study of Hate and Extremism at California State University, San Bernardino.

Levin, whose own research saw a staggering 224% increase in anti-Asian crimes last year, as well as big increases in bias crimes against Jews, Latinos, Black people and members of the LGBTQ community, said the result is that the new FBI report is an out-of-focus snapshot on what's going on in America. "Todays overall FBI numbers simply do not reflect the increases were seeing across more reliable and consistent data from a smaller but more consistent set of police data," he said. Anti-Defamation League CEO Jonathan Greenblatt echoed that criticism. Hate crimes tear at the fabric of our society and traumatize entire communities, he said. The failure by major states and cities across the country to report hate crime data essentially and inexcusably erases the lived experience of marginalized communities across the country. The FBI acknowledged that the newest hate crimes numbers, culled from 11,834 law enforcement agencies nationwide, were incomplete. As has been the case for many years, most of the "known offenders" cited by the report are overwhelmingly white (56.1%) and most of the victims (64.8%) were targeted because of their race or ethnicity.

Greenblatt said the Jewish community has experienced a major uptick in religious-based attacks in 2021 but the FBI report does not reflect that because it does not include data from the big cities that, historically, have had relatively high numbers of reported anti-Jewish hate crimes. Especially at a time when our communities are feeling particularly vulnerable to hate crimes and extremist-fueled attacks, it is egregious that major cities and states across the country have failed to report comprehensive data for 2021, he said. We urge Congress to make it mandatory for state and local law enforcement agencies that receive federal funding to participate in the FBIs hate crime data collection efforts." Levin's research, which includes data from 18 states and the District of Columbia, recorded 8,896 hate crimes in 2021 and "a wave of anti-Asian violence." We showed a record for anti-Asian hate, but when you leave out New York City, L.A., yeah, and Chicago too, and youre functionally leaving out Florida and California, this is devastating for the data," he told MSNBC's Katy Tur.

Lebronwon

https://www.thedailybeast.com/why-jd-vance-poses-a-serious-threat-to-the-porn-industry

The war on porn could get even worse in 2023 thanks to new Ohio Sen. J.D. Vance, who has said he wants to ban porn nationwide. Vances proclamations come at a time when fringe extremists, including Ye (the rapper formerly known as Kanye West), are pushing for porn prohibition. Their demands may lack legal grounding, but they pose serious threats. If youre unfamiliar with Vance, here are the Cliff Notes: The Yale Law School grad rose to prominence with his memoir, Hillbilly Elegy, about growing up poor and white in America. After the mainstream media embraced him (Netflix made a film adaptation of his life, starring Glenn Close as his grandmother), Vance pivoted far right, running as a MAGA Republican in Ohio and winning a Senate seat last month. Among the several scary opinions Vance voiced during his campaign was his belief in a complete ban on porn. I think the combination of porn, abortion have basically created a really lonely, isolated generation that isnt getting married, Vance complained to Crisis magazine in 2021. Theyre not having families, and theyre actually not even totally sure how to interact with each other.

If Vance were a lone anti-porn senator, he would be frightening but less dangerous. Unfortunately, many other Republicans hold anti-porn views. According to The Guardian, Missouri Sen. Josh Hawley blames feminism for driving men to porn (whatever that means), while West Virginia Gov. Jim Justice blamed porn for school shootings. Most frighteningly of all, these are mainstream Republicans. More fringe actors take things even further. In a recent episode of Vice Media and Proud Boys founder Gavin McInnes streaming show, Ye pushed a gross antisemitic conspiracy theory that Jews operated ******* to poison peoples minds. Ironically, Ye made these statements while complaining about being canceled. Similarly, Republicans have painted themselves as free-speech warriors while seeking to silence pornographers speech. I have heard conservatives argue that the First Amendment only protects political speech. But the last time I checked, it was the Supreme Courtnot conservative senators or political consultantswho ruled on speech, and the court long ago protected legal consenting adults rights to create and sell porn. Free speech also protects visual art, parody, and other non-political speech. The First Amendment covers more than Yes and other conservatives rights to spout nonsense. Its unlikely that Vance could actually pass a law banning porn (good luck getting Congress to pass anything), and if he successfully pushed legislation, the Supreme Court would likely overturn it. But politicians and fringe voices agendas can nonetheless create a mood that stifles speech. Its likely porn stars like myself wont suffer from whatever 2023 has in store for this industry; I live in liberal California and am an older successful performer with a diversified business. Ive survived several porn eras, and I wont go away. But pornographers in red states and younger stars could find their livelihoods threatened by political leaders like Vance.

A lot of the stuff I post on Gamefaqs I also post on Reddit. And they constantly go to the front page of Reddit. While on Gamefaqs they might attack the TC instead of responding to a specific post. That kind of stuff of saying what is TC agenda doesnt happen over there.

A butterfly activist drugged and strangled her former stepfather after finding nude pictures of herself on his computer, prosecutors alleged. Thomas Merrimans body was found in January 2021, under a pile of trash at the Solana Beach, California, home he shared with stepdaughter Jade Janks, the NY Post reports. The murder trial of Ms Janks, 39, an interior designer who co-founded the research non-profit Butterfly Farms, began this week in Vista Superior Court. She has pleaded not guilty to killing the 64-year-old Mr Merriman, who prosecutors said died of an overdose of sleeping pills Janks gave him after she discovered the photos one of which he reportedly used as his screensaver. This was no accident, San Diego County Deputy District Attorney Jorge Del Portillo said, according to The San Diego Union-Tribune. This was murder by design.

The photos were taken more than a decade ago, consensually, by Ms Janks and her boyfriend, authorities said. Its unclear how they came into Mr Merrimans possession. Ms Janks found the photos while she was cleaning her stepfathers apartment, who had been hospitalised, Mr Del Portillo added. She texted with another man about giving Mr Merriman the pills, prosecutors contended. I just dosed the hell out of him. Stopping for whiskey then at Dixieland to stall. LMK, Ms Janks allegedly texted the day she picked Mr Merriman up from the hospital, according to Mr Del Portillo. Ms Janks seems to second guess her plan in another text message the prosecutors shared. Hes waking up, one alleged text read, according to NBC San Diego. I really dont want to be the one to do this. I am about to club him on the head as he is waking up, another read. Ms Janks eventually called another person for help, said prosecutors. That person called the authorities the next day. Deputies then searched the home and found Mr Merrimans body under a pile of boxes, blankets and other trash as they were leaving. Attorneys for Ms Janks argued that she did not kill Mr Merriman, who instead died from poor health and his own cocktail of drugs.

TopicShort men have more psychopathic traits, study finds

https://www.nzherald.co.nz/lifestyle/short-men-have-more-psychopathic-traits-study-finds/PRSLTCN5C5H63IDGRODQRXNHYY/

It seems like only yesterday that we were heralding the arrival of short king spring. Women took to TikTok to propose that tall men had dominated the dating scene for too long. Something was in the air, and that something was the reign of males less than 172cm (58) in stature. If it was good enough for Zendaya, it was good enough for the rest of us. Short king status is, more than anything, a state of mind, if you will: an openness to everything that life at a slightly lower altitude has to offer, which can apparently be a lot, Kylie Cheung wrote in a recent article for Jezebel, where she pondered what, exactly, makes a short king a short king. Short kings embrace who they are and who their partners are; they treat everyone, including themselves, with respect. Like big dick energy, the short kings height only compounded their magnetism. On top of which, the Journal of Sexual Medicine found they enjoy more frequent sex, and are 32 per cent less likely to divorce if theyre under 59 (175cm). But if weve learned anything in 2022, its that cancel culture comes for us all in the end. If you were about to embark on a search for a short king of your own, know that it may come at a cost: a group of Polish scientists have found that short men may actually be evolutionarily hardwired to whats known as the dark triad personality traits, associated with more confrontational behaviour.

For the unversed, those include psychopathy (lack of empathy and anti-social behaviours), narcissism (self-centredness), and Machiavellianism (manipulation and indifference towards mortality). Our study provides the first assessment (we know of) of how the dark triad traits relate to height and height attitudes, the researchers wrote in the study of 367 men and women, published in the Elsevier journal Personality and Individual Differences. We showed that not only are people high on the dark triad traits less satisfied with their height, but this may be because they are actually shorter. This leads us to believe that the behavioural syndromes of the dark triad traits may be part of a suite of psychological systems designed by natural selection to better enable those of shorter stature a way to still compete in lifes great challenges. While shorter women can use deception to appear more desirable or to gain protection and resources, the scientists did not see the same link between the dark triad personality traits and their height. The research was rooted in investigating the so-called Napoleon complex named after the (allegedly) 157cm (52) leader who sought power through aggression and was mocked by British newspapers for his height during the French revolution and found the myth was grounded in truth. They theorise that when a person is not physically formidable and does not have an intimidating presence, they have to impose themselves in other ways, becoming psychologically formidable instead, lead author Monika Kozlowska, from Polands University of Wroclaw, said. Appearing more powerful may in turn make other people perceive them as taller than they really are, she added. Shorter men with traits such as psychopathy can use them to demand respect, impost costs on others and impress romantic partners. In short (whoops), if your mans smaller than 172cm, he might be more Patrick Bateman than Prince Charming. Sorry, Tom Cruise.

https://www.cnbc.com/2022/12/08/financial-crimes-justice-department-tells-bankers-to-confess-their-misdeeds.html

Banks and other corporations that proactively report possible employee crimes to the government instead of waiting to be discovered will get more lenient terms, according to a Justice Department official. The DOJ recently overhauled its approach to corporate criminal enforcement to incentivize companies to root out and disclose their misdeeds, Marshall Miller, a principal associate deputy attorney general, said Tuesday at a banking conference in Maryland. When misconduct occurs, we want companies to step up, Miller told the bank attorneys and compliance managers in attendance. When companies do, they can expect to fare better in a clear and predictable way. Banks, at the nexus of trillions of dollars of flows around the world daily, have a relatively high burden for enforcing anti-money laundering and other legal and regulatory requirements. But they have a lengthy track record of failures, often due to unscrupulous employees or bad practices. The industry has paid more than $200 billion in fines since the 2008 financial crisis, mostly tied to its role in the mortgage meltdown, according to a 2018 tally from KBW.

Traders and bankers have also been blamed for manipulating benchmark rates, currencies and precious metal markets, stealing billions of dollars from developing nations, and laundering money for drug lords and dictators. The carrot that Justice officials are dangling before the corporate world includes a promise that companies that promptly self-report misconduct wont be forced to enter a guilty plea, absent aggravating factors, Miller said. They will also avoid being assigned in-house watchdogs called monitors if they fully cooperate and bootstrap internal compliance programs, he said. The first incentive carries extra weight for financial firms because guilty pleas can cause catastrophic issues for the highly regulated entities; they could lose business licenses or the ability to manage client funds unless theyve negotiated regulatory carveouts. The message every corporation should hear is that the best way to avoid a guilty plea for some companies, the only way to do so is by immediately self-reporting and cooperating when misconduct is discovered, Miller said.
