On Thursday, the United States Equal Employment Opportunity Commission announced a lawsuit against Sheetz, alleging the convenience store and gas chain of denying employment to a class of job application due to their race.
The U.S. EEOC alleges that Sheetz has a practice of screening all applicants for records of criminal conviction and then denying them employment based on said record . The EEOC's charge claims that Sheetz disproportionally screened out applicants who are black, Native American, and multiracial.
The lawsuit does not allege that Sheetz was motivated by race when making hiring decisions.
"Federal law mandates that employment practices causing a disparate impact because of race or other protected classifications must be shown by the employer to be necessary to ensure the safe and efficient performance of the particular jobs at issue," said EEOC Regional Attorney Debra M. Lawrence. "Even when such necessity is proven, the practice remains unlawful if there is an alternative practice available that is comparably effective in achieving the employer's goals but causes less discriminatory effect."
The alleged conduct, according to the EEOC, violates Title VII which prohibits facially neutral employment practices that "cause a discriminatory impact because of race when those practices are not job-related and consistent with business necessity or where alternative practices with less discriminatory impact are available."
The lawsuit was filed in the U.S. District Court for the District of Maryland following an attempt to reach a pre-litigation settlement.

I admit my legalese isnt the best, but it says right under the bold that the lawsuit doesnt allege that they were motivated by race when making hiring decisions. so..what are they actually suing for?

From what i could parse, they should have been able to observe that a byproduct of their screening was a lack of diversity and have taken steps to correct it.

Like, "not hiring people with criminal records" sounds good on paper until you remember that law enforcement disproportionally creates those criminal records

i was confused a bit at first because all the jobs Ive worked at do hard background checks and any state level felony eliminates the person immediately

it's illegal if they can't prove that the criteria is relevant to the person being able to do the job successfully and safely

Hiring criminals makes the workplace unsafe. Should be an easy win for Sheetz. Lots of major employers dont hire people with felony convictions.

Yeah that's crap. Ive worked with non felons who are straight up psychopaths and excons who were some really nice people. Outta here with this bullshit

Like yeah obviously don't hire the child toucher as a teacher, but Sheetz is a fucking store. I bet they pay shit, they're not special enough to auto disqualify all felons.

(As an aside, it's pretty shitty that we make it so difficult for ex cons to get a job and pick up the pieces of their life. Almost as if someone profits from them being driven back to crime)

what do you base this on? For Sheetz to be allowed to do this, they'd have to prove that "criminals" wouldn't be able to do the job effectively and safely.

Disparate impact. The quoted part from the OP explains it right after the line about not being motivated by race.

To people saying there's no case here: you're very very likely wrong. The EEOC could lose due to a lack of evidence or a bad judge, but blanket criminal records bans are known to have an unjustified and illegal disparate impact based on race. It has to be a crime that's relatively recent, and relevant to the specific job. The policy can't be overbroad. This isn't just in employment, it's also in housing and other relevant civil rights laws.

I'm saying this as someone who has brought cases like this under both housing and employment laws.
