Not a genuine question. America has the most robust freedom of speech in the world. In order for him to be held liable here would require him to go above and beyond.

He's allowed to defend himself against her allegations. He's not allowed to lie in a manner that damages her reputation. If he's been found guilty of defamation (twice), that means he's been found to have lied in a manner that damages her reputation.
