It escalated after the officers demanded to look in her backpack and she asked if they had a warrant..The Officer then grabbed her by the wrist and neck and punched he and threw her to the ground where she was then bitten by a dog.
The cops later told her mom it was a case of mistaken identity and when she asked if her daughter was ok, the cop said "Well she's alive and she's in the hospital"
The real suspect was 24 y/o Douglas Washington who now in jail..
Do you think Tatyana matches a description of a 5'10 Bald Man at 170lbs? let's see what people think

Everything aside, no matter what she looked like, unless they have a good reason to believe that she too, had a machete, any level of force is unacceptable. It will probably never go anywhere but she needs to sue anyway.
You don't need a warrant for a street search. You don't even need it for a search of a car.

... and there is the problem. I often notice in these stories the reason these things happen is because the "victim" is stupid.
for the record this is about the height difference between her and the suspect they thought she was.

Danny Devito is 4'10". George Clooney is 5'11". That's THIRTEEN inches of difference vs eight, or another FIVE inches. More importantly, no bike is involved. Given that a lot of height is in the legs, sitting down brings the height even closer and makes it harder to tell
The NAACP caught wind of the attack that contends that race played a role in the incident as the video viewed more than 3 million times.

my internet search failed me, it said he was 5'0" and I used him because I didn't have a good picture of him and ben stiller, but if he is only 4'10" robin williams would be fairly close.
Best I have of robin williams.

Still a pretty big difference and only an inch difference.
That said my mom is about 5'2" she could be sitting, on a bike, on a ladder, in an suv, there is no situation where she looks 5'10". That said if you are having a hard time telling her height from her being on a bicycle ask her to step off the bicycle for the stop. That is a legal request unlike searching her bag without probable cause.
Again, you can't reliably judge height on a bike; it's hard enough to accurately gauge height while somebody is just sitting in a chair. You're always going to be off by a margin. Plus height evaluations are relative to your own height. It's not like they're sticking a tape measure next to the person.

Im not saying you can accurrately say she is 5'2 while she is on a bike. Maybe you think she could be 5'5, but you should accurrately be able to say she is not 5'10. That is a large difference even on a bike.
Except you can't. When a bike is in motion,
And again, nobody just knows what these heights look like, as you demonstrated by getting two peoples' heights wrong
And, in general, if I saw a 5'10" person, I'd assume his height could be as low as 5'5" -- because all I know is that he's a good deal shorter than me -- and somebody who's 5'2" I might think is as tall as 5'5". Seeing them side by side would make the difference obvious, but they weren't looking at two people side by side. They were looking at one person on a bike.
As I said, I dont think there was a problem stopping her. The problem is after she was stopped and they could talk to her, ask her to get off the bike, and do a general once over they still decided that they needed to check her bag. But by that point they had her stopped long enough to check her bag they should have had the time to see she was not a 5'10 170 lbs man. There are steps inbetween stopping someone and digging through their stuff.
They had reasonable suspicion to stop her, but not to search her.
I agree. Small differences in height can reasonably be confused especially at a distance, but she was detained and talking to the officers who are suppossed to be trained observers. It is understandable that you may not be used to estimating someones height, but it is a very important part of their job that they can tell the diference between 5'2 and 5'10 for this exact reason. They need to be able to descrribe and identify suspects.
Suspects they are standing next to having a conversation with should be easy mode for their job.
Again, bike. Plus you're overestimating the amount of "height training" that officers get which is automatically going to be thrown off by a bike.
Again, you can't really tell when somebody is on a bike and she immediately resisted. Given that she was on a bicycle, she was automatically a high flight risk. Bikes are more maneuverable than cars in urban settings and faster than people.
