There's some contention already about what happened on January 6th in the DoD. Kash Patel is insisting that Trump authorized 10,000 - 20,000 national guard troops on January 6th, but they didn't want to send them without a civilian request.

This is an annoying ass talking point for a number of reasons. It goes back to the earlier conversation about how you can't have an intellectual conversation with people like that and you have to stop and teach them the basics. It makes no sense at all. On January 6th, 2021:
  • Nancy Pelosi, as Speaker of the House, is in the legislative branch of government.
  • Mitch McConnell, as Senate Majority Leader, is in the legislative branch of government and the head of the other part of Congress, but Republicans don't blame him.
  • The DC National Guard falls under the executive branch. Nobody in the legislative branch has any authority of the DC National Guard.
  • The chain of command for the DC national guard is POTUS > Secretary of Defense > Secretary of the Army. That's it.
  • We also have video of Nancy Pelosi calling governors of other states to try to get them to send their state's national guard to DC to help while people were storming the captiol. Why would she do that if she could just command the DC national guard?

regular Army troops can be deployed on US territory also, but I feel like that would have actually had to be preemptive instead of a reaction. Trump knew full well what was going to happen and did nothing ahead of time to stop it.

I'm pretty sure they need to actually come up with a legal justification for their misdeeds, though, instead of just saying they relied on accountants and lawyers... It'll be interesting to see how the judge rules on the rest of the allegations.

The New York civil fraud trial is expected to end around December 22nd, I believe.

We've seen a ton of evidence that they were not accurate," he said. "So I think today, New York State set him up. He was already visibly uncomfortable with some of the questions. We're going to see the payoff tomorrow. Probably not so good for Trump Jr. or for the Trump family's standing in this case."

Fellow CNN legal analyst Elie Honig, a former federal prosecutor, noted that Trump Jr. did not try to argue that the inflated valuations at the heart of the lawsuit were actually accurate.

He tried to argue, I didn't really know about them, I wasn't part of this. He tried to distance himself from the actual valuations, Honig said.

"Donald Trump Jr. would have had the option of taking the Fifth Amendment," he said. "This is a civil case, but he still could say, I refuse to testify because my testimony could be used against me. He's decided not to do that, and so now as a result, everything that he's testifying to is fair game for prosecutors to consider. Prosecutors have looked at this case. They have chosen not to charge it as a criminal case thus far, but that could change based on Donald Trump Jr.'s testimony, so there's an inherent risk in taking the stand here."

Former federal prosecutor Kristy Greenberg told MSNBC that the Trumps M.O. appears to be to just point the finger at somebody else, whether its the CFO, whether its the accountant, whether its the lawyer, anybody that doesnt have the last name Trump. But Trump Jr. ultimately signed these statements of financial condition and said that they were accurate.

You cant have it both ways, she added. If he was on The Apprentice right now, youd be fired.

It's some dumb shit Trump keeps trying to argue every time he faces some sort of accusation about the illegal things he did. He's of the mind that presidents can do whatever they want with no repercussions. He has tried the presidential immunity argument in court multiple times and it has always been thrown out.

Definitely an uncharted waters thing... I haven't done too much research on this, but I think (from a quick google search just now) Minnesota allows people to write in who they want to vote for even if their name isn't on the ballot. It is a thing but only for civil suits and only for actions taken as part of the duties of president.

Trump & other white wingers really like to stretch it. Also completely tone deaf to the idea that in order to benefit from immunity means you have to be guilty otherwise the immunity doesn't do anything for you.
