From where I sit, it seems pretty obvious all that stuff is fake and just preys on the vulnerable.
On the other hand, you could consider it free speech.

For Entertainment Purposes Only covers a lot.

Thats like saying you should be able to sue a cartoon because the talking dog told you as a kid that you can be anything you want if you just wish on a star.

There's definitely a difference here though... that talking cartoon dog is not using cold reading and various tricks to ascertain personal information and then pass along life "advice" and possibly grift or defraud money from the children watching the screens.

At worst they are getting kids to beg their parents for toys and sugary cereals.

The only people that get manipulated are the ones that allow themselves to be manipulated.

Kinda like how people that dont believe in hypnosis cant get hypnotized.

In this particular case, yes its victim blaming. And rightfully so.

This isnt a If you dont want to get robbed, dont work the overnight shift at a 7-11 victim blame. This is a Maybe you shouldnt give your social security number to a lady that says she can talk to your dead cat situation here.

Were talking about a psychic, not a guy that falsifies documents to make him look like a life insurance salesman in order to con old people.

If you give your social security number to somone and they steal your identity, that's still fraud. People get prosecuted for that type of thing all the time. Should the lie they told to scam somone really excuse it?

To the point where they shouldn't be prosecuted? No.

To the point where we shouldn't also be able to chastise the "victim" for not seeing the scam 100 miles away? Also no.

Now, you instantly took it to the extreme with stealing identities and whatnot, when I was originally talking about someone paying $40 to have their palm read.

I don't consider that a scam, I consider that someone getting paid by someone in exchange for being entertained.

So yes, it's fairly obvious that if someone uses the veil of being a "psychic" to steal people's identities, it's is not a good thing and should be punished to the fullest extent of the law.

But if someone is offering $40 palm readings at a bachelorette party, and then says something like "Things are still a little hazy, but another $100 would help the spirits clear things up" and you give them the $100, they yes, I will 100% victim blame in that scenario.

Yeah, that's how they get away with it.

I was walking along the boardwalk on Venice Beach once and a lady asked if I wanted a psychic reading. I told her she should already know the answer to that.

She was not entertained.
