Depends.

As the Spectre is The Presence's (DC's version of the One Above All) wrath/vengeance made manifest, if The Presence is really, really wrathful/vengeful during the fight, then The Spectre wins.

In other words, if The Presence is actively aware of the fight and is using the Spectre (empowering him with all his might).

Otherwise, the Living Tribunal will probably win.

But it also depends on whether the Living Tribunal has done something that goes against the Spectre's mission (as given to him by The Presence). For the Spectre is automatically empowered by The Presence with all the necessary power to fulfill his mission.

So if the Living Tribunal murders an innocent in cold blood, the Spectre wins. If the Living Tribunal isn't doing anything to provoke the Spectre, then the Living Tribunal wins.
