The speaker is second in the United States presidential line of succession, after the vice president and ahead of the president pro tempore of the Senate."

Trump can be on that list.

Democrats would.simply refuse to recognize him. Frankly they need to outright remove him from the ballot and ignore anyone saying otherwise including court rulings. Once the election is past the case becomes moot.
